Registry done, mutation not done: what changes legally?
A valid registered transfer and a mutation entry perform different functions. The conveyance and the transferor's rights determine the ownership effect of the transaction; mutation updates the relevant administrative or revenue record under its governing process. A pending mutation does not automatically cancel a valid registered sale, and a mutation entry does not cure a defective title.
The practical consequences of an outdated entry can still be significant. Revenue demands, future searches, loan documentation, authority transfers or sale preparation may continue to show the earlier holder. The buyer should therefore complete the applicable update and preserve the order and resulting record.
This 2026 UP guide explains how to distinguish ownership from record administration and how to address a pending mutation. It does not assert that every registry triggers an automatic update, that every property uses the same authority or that a fixed processing time applies statewide.
Start with the property type and the record that remains unchanged. A rural khatauni, an urban house-tax entry and an authority lease account are different systems. Updating one does not necessarily update the others.
Registration, mutation and other post-purchase records
| Record or process | What it addresses | What it does not replace |
|---|---|---|
| Registered sale deed | The instrument conveying the described interest through the registration process. | Seller's title, authority, planning compliance and possession still require their own examination. |
| Revenue mutation | The administrative entry reflecting a legally relevant event in the revenue record. | It is not an independent source of title and does not decide every disputed ownership issue conclusively. |
| Municipal name update | The relevant local-tax or municipal administration record. | Payment of house tax in a name is not a universal ownership certificate. |
| Authority transfer entry | Records under an allotment, lease or authority property framework. | It does not waive transfer conditions, dues or restrictions in the governing documents. |
| Utility change | Consumer records for electricity, water or other service arrangements. | A utility bill does not establish ownership or validate an unauthorised structure. |
| Possession handover | Actual delivery of the property and agreed documents. | An updated administrative entry does not physically remove an occupant or deliver keys. |
Why mutation may still be pending
First establish whether an application was actually made, which authority received it and what stage it has reached. A deed writer's assurance that the process is automatic is not the same as an acknowledgement, proceeding number or order.
The file may be incomplete, linked to inconsistent parcel details, awaiting the required inquiry or affected by an objection. A registered deed may describe only a share, while the application asks for an exclusive plot entry. That is a substantive mismatch, not merely a delay in typing the purchaser's name.
| Situation | What to check | Focused response |
|---|---|---|
| No application reference | Whether a separate filing or linked process was required and actually initiated. | Identify the competent service and obtain the proper acknowledgement. |
| Wrong parcel or office | Village, khasra or gata, jurisdiction and deed schedule. | Correct the request through the appropriate process using supported property identifiers. |
| Incomplete documents | Deed copy, applicant identity, relevant orders and service-specific requirements. | Supply the missing material and preserve the submission acknowledgement. |
| Seller's entry differs | Acquisition chain, earlier mutation and current holding information. | Establish the reason and obtain the relevant underlying records. |
| Objection filed | Notice, objector's claim and the proceeding record. | Address the actual objection with title and transaction evidence before the competent authority. |
| Order passed but entry unchanged | Complete order, operative directions and present record. | Seek implementation through the proper office with the order and acknowledgement. |
Identify the correct authority for the property
For land in the revenue record system, identify the competent revenue authority and current prescribed mutation process. Use the property's actual district, tehsil and revenue village. A municipal address may help locate the site but may not identify the revenue jurisdiction accurately.
For urban or authority property, identify whether a municipal, development authority, housing body or other record also needs updating. An LDA leasehold or allotted property can involve transfer conditions separate from revenue mutation. Read the original allotment, lease and conveyance.
The Lucknow district administration, UP Board of Revenue and relevant official service gateways help identify the responsible office. Do not assume a private online application form is the government service.
Documents for a mutation file after registry
| Document group | Material to prepare | Main purpose |
|---|---|---|
| Registered transfer | Complete deed with schedules and registration endorsements or accepted official copy. | Establishes the event and interest for which the entry is requested. |
| Property record | Current relevant khatauni, parcel or account reference and existing entry. | Connects the request to the correct holding and identifies the present recorded position. |
| Applicant identity | Accurate accepted identity and contact details, with lawful representation if used. | Identifies the person seeking the update and the person authorised to act. |
| Title connection | Earlier acquisition, partition, succession or correction material where the current record requires explanation. | Resolves a gap between the seller's deed and the existing entry. |
| Prior proceedings | Notices, orders, applications and acknowledgements affecting the holding. | Establishes what has already been decided or remains under consideration. |
| Area and share material | Deed area, share calculation, map or relevant subdivision document. | Prevents a request for a different interest from the one actually acquired. |
Keep the complete deed, not just its first page. An entry may depend on a schedule, share clause or later rectification. The application should ask for the change the deed legally supports rather than a more extensive entry for convenience.
A practical application and tracking workflow
Locate the official process for the relevant property and submit a complete, accurate application. Preserve the reference, filing date and documents supplied. Where a government payment is required, retain the official receipt separately from professional assistance charges.
Read any notice and identify the exact information or response requested. Attend or respond through lawful representation as applicable. A missing response can leave the authority without the facts needed to determine the request.
After the decision, obtain the order and check the resulting record. An application marked disposed does not necessarily mean every requested change was granted. The operative order and updated entry should be read together.
| Field | What to record | Why it helps |
|---|---|---|
| Application | Authority, date, reference, property and event relied on. | Defines the actual request and prevents confusion between separate record systems. |
| Documents | List of deeds, extracts, orders and identity material submitted. | Shows whether a later demand concerns a genuinely missing item or an already supplied document. |
| Notice or objection | Issuing authority, issue, response date and supporting records. | Keeps the proceeding focused on the question that needs determination. |
| Hearing or submission | Attendance, written response and acknowledgement. | Preserves what was placed before the authority without relying on oral recollection. |
| Order | Complete text, date and operative direction. | Establishes what was allowed, rejected or otherwise decided. |
| Implementation | Updated entry, record period and any remaining discrepancy. | Confirms whether the administrative result matches the order. |
What happens to a buyer's title while mutation is pending?
The ownership analysis remains tied to the valid instrument, seller's rights and applicable law. The absence of a completed mutation does not itself undo a valid transfer. Conversely, securing an entry cannot give a buyer rights that the seller lacked.
This distinction helps answer an overly simple objection that “your name is not in khatauni, so you own nothing”. It also prevents the opposite mistake of treating a registered deed as an answer to every share, restriction or title defect. Examine both the source of rights and the record position.
Keep the registered deed and related title material available while the entry is being updated. For important dealings, disclose the actual pending status and provide the application or proceeding documents rather than presenting an old entry as current.
Can the property be sold or mortgaged before mutation?
A future sale or mortgage requires examination of the actual title and transaction requirements. A pending administrative update does not automatically answer every question of transferability. The purchaser, lender or authority may require the pending record issue to be resolved or explained with supporting documents.
A buyer should not be asked to ignore a substantive discrepancy as “only mutation”. If the pending file reveals an ownership objection, wrong parcel or missing share, investigate it. If the title is coherent and the issue is administrative, document that distinction and the steps to complete the update.
| Question | Evidence to provide | Point to resolve |
|---|---|---|
| How did the seller acquire title? | Registered deed and material chain or succession records. | The actual legal interest held, independent of a delayed administrative entry. |
| Why is the entry outdated? | Mutation application, notices, order and current status. | Whether the issue is filing, implementation, discrepancy or a substantive dispute. |
| What does the lender or buyer require? | Written document checklist and transaction scope. | The records or conditions required for that particular dealing. |
| Is a share involved? | Title shares, partition or other allocation documents. | Whether the proposed transfer corresponds to the interest acquired. |
| What will be delivered at closing? | Updated entry or a clearly documented agreed condition, as appropriate. | Prevents the pending issue from remaining an undefined promise after payment. |
Objections, refusal and disputed ownership
Read the objection or refusal in full. It may concern identity, parcel description, the effect of an earlier order or a competing claim. The next step depends on the legal basis and forum, not simply on the fact that the applicant has a registered document.
A clerical correction and a contested title dispute are different proceedings. Use the applicable correction, challenge or adjudication route for the actual issue. Revenue mutation is not a substitute for every civil or revenue suit that the rights dispute may require.
Preserve the order and obtain advice on the applicable remedy and time requirements promptly. Repeated informal visits do not necessarily replace a formal challenge. Our property title declaration guide explains the distinction between record entries and substantive title relief.
Example: sale deed correct, older holder still displayed
Assume a purchaser has a registered deed identifying the correct parcel, but the online khatauni still shows the seller. The buyer should locate the mutation filing or initiate the applicable process, compare the deed and existing entry, and track the order and implementation.
| Position | Evidence to examine | Next action |
|---|---|---|
| Application never filed | Registry papers and absence of an official mutation acknowledgement. | Use the competent application process rather than waiting for an assumed automatic update. |
| Application allowed, entry not updated | Operative order and present extract. | Seek implementation and verify the resulting record. |
| Application disputed or refused | Complete notice, objection or order and supporting title material. | Address the actual issue through the appropriate proceeding or challenge route. |
The visible old name alone does not tell you which position applies. The application and order file supply the answer. That is why a complete follow-up record is more useful than repeatedly refreshing the same portal page.
Final post-registry checklist
| Task | Completion evidence | Separate issue to remember |
|---|---|---|
| Revenue update where applicable | Order and resulting khatauni or other relevant entry. | Title still depends on the underlying rights and documents. |
| Municipal update where applicable | Acknowledgement and corrected local record. | Tax assessment does not sanction unauthorised construction. |
| Authority transfer where applicable | Required permission, dues compliance and updated authority record. | Lease and allotment conditions remain relevant. |
| Utility changes | Correct consumer account and agreed meter or service handover. | Service records are not ownership documents. |
| Document custody | Registered deed, originals, orders and receipts in an indexed file. | Lender security or missing originals need their own explanation. |
Verify the entry after it changes, not just the name
An updated name is not the only quality check. Compare the parcel, area, share, tenure and relevant order references with the deed and mutation order. A successful administrative update can still contain a transcription or scope error that should be addressed through the correct process.
This is especially important where the buyer acquired only part of a holding or an undivided share. The resulting record should reflect the legal interest allowed by the order; it should not silently turn a share purchase into exclusive ownership of a different portion.
| Field | What to compare | Why it matters |
|---|---|---|
| Holder details | Genuine identity, spelling and the capacity recognised in the order. | Reduces later mismatch in loan, sale or administrative applications. |
| Property identity | Village, gata or khasra and any subdivision reference. | Confirms the update concerns the land actually transferred. |
| Area and unit | Deed, order and resulting record, including unit conversion where relevant. | Prevents a correct name from masking an incorrect extent. |
| Share | Interest acquired and the order's treatment of co-owners. | Avoids an unsupported exclusive entry over jointly held land. |
| Remarks and orders | Relevant mutation reference and other continuing material entries. | Keeps the administrative history connected to its legal basis. |
| Record period | The entry obtained and its relation to the order and later changes. | Establishes the date and context of the copy used for future dealings. |
If an error is found, distinguish an implementation mistake from disagreement with the underlying order. The first may call for correction or proper implementation; the second may require a challenge to the decision itself. Attach the documents that explain which problem exists.
Keep an earlier extract, the mutation order and the corrected or updated extract together. That sequence helps a future purchaser understand why the names or area changed and avoids repeated requests for an explanation that the file can already supply.
The same discipline applies to municipal and authority records. Check not just the name but the property reference, account, rights and obligations shown. A utility account can be changed correctly while an authority transfer remains outstanding, so close each workstream separately.
A complete post-registry file therefore records both the change requested and the change actually made. That is the practical standard for saying mutation is finished.
Frequently asked questions
Does pending mutation make a registered deed invalid?
Not automatically. Examine the validity of the transfer and seller's rights separately from the administrative update. The reason for the pending entry still needs to be understood.
Does a mutation entry prove ownership conclusively?
No. It is an administrative or revenue entry under its governing framework. Read it with the underlying deed, succession or other source of rights.
Is revenue mutation the same as house-tax name change?
No. Different authorities maintain different records. Identify every applicable update instead of assuming one application changes all systems.
What if an order was passed but the portal still shows the old name?
Obtain the complete order, identify the implementation step and approach the competent office through the prescribed process. Then verify the resulting entry and retain it.

The practical solution is to establish the valid transfer, identify the correct update, file a complete request and track it to the order and resulting entry. That closes the gap between the title document and the administrative records used in future dealings.
