Overview

How the Firm Assists Clients Here

Varanasi, in eastern Uttar Pradesh, has a long-established trading and handloom economy and a great deal of old, closely held urban property. Both of those shape the instructions that come from the district: family property questions with long histories, and small-business documentation and compliance.

Property in older parts of a city like Varanasi frequently passes within families over generations without every step being documented. The result is a chain of title with informal links in it — an oral partition, a share never formally released, an heir never brought on the record. Those gaps are not fatal, but they have to be identified before a sale rather than after one.

The other recurring instruction is from small and family-run businesses: a partnership that has been running on an understanding, invoicing without written terms, or a GST question that has produced a notice. The work in both cases starts by reconstructing what the documents actually establish.

Getting started

How Consultation and Document Review Work

For property matters, the useful first step is to list what documents exist and who holds them, including for the earlier links in the chain. Copies can be sent ahead; originals are examined at the Lucknow office before any transaction proceeds.

  1. Step 01

    First discussion

What has happened, what is sought and whether anything is running against time.

  2. Step 02

    Document review

The papers already held are read, and anything still to be obtained is identified.

  3. Step 03

    Scope and next steps

The available course of action, the work it involves and its likely stages are set out before it is begun.

Remote

Matters That May Begin Remotely

Whether a particular matter can be taken this far without a meeting depends on the papers, and is settled at the outset rather than assumed.

  • A first discussion about what has happened and what is sought, by telephone or video call.
  • Reading scanned documents — agreements, notices, returns, orders and correspondence — before originals are seen.
  • Drafting and settling notices, replies, agreements and deeds, with revisions exchanged electronically.
  • Preparing and submitting registration and return filings that are made online.
  • Written replies to notices issued by a tax or registration authority.

In person

Matters That May Require Physical Appearance

Some steps cannot be completed remotely. Where attendance is required, that is said in advance rather than discovered on the day.

  • Execution and registration of a deed, where the parties must attend the registration office in person.
  • Hearings where the court, tribunal or authority requires a party rather than only the advocate to be present.
  • Examination of original title documents, which frequently cannot be assessed from a photograph or a scan.
  • Recording of evidence, and any proceeding in which a party must be identified in person.
  • Any step for which the forum concerned directs personal attendance.

The practice

Advocates

Each advocate of the firm is enrolled with the Bar Council of Uttar Pradesh and holds a Certificate of Practice. All three work from the Lucknow office.

Questions

Frequently Asked Questions

An oral partition is frequently asserted and is hard to prove. What helps is contemporaneous material — who has been in possession of what, who has paid the taxes, and how the revenue or municipal records have been maintained since. Those are examined before any view is taken.

Often, but the gaps have to be identified and dealt with first. Certified copies can usually be obtained from the office where a document was registered, and missing links in the chain can sometimes be established another way. It is far easier to do before a buyer's advocate raises it.

It becomes one when a dispute arises or a tax question is raised, because there is nothing to point at. Putting short, clear terms in writing is usually inexpensive and is the single most useful thing a small business can do.
