About this area of practice
A civil case begins with a plaint setting out what happened, what right is said to have been infringed and what relief is asked for. The other side files a written statement, the court frames the questions it has to decide, evidence is led on both sides, arguments follow and a judgment and decree are pronounced. A decree that is not honoured then has to be executed, which is a separate stage in itself.
Most civil work is decided on documents. A matter that is prepared properly at the outset — with the agreement, the receipts, the correspondence and the record of what was paid and when — is in a materially different position from one assembled after the dispute has hardened. Yes. The Limitation Act, 1963 prescribes periods that differ with the nature of the claim, and a claim filed after the period has run is ordinarily barred. Because the period and the date it starts from both turn on the facts, the position should be worked out on your documents before anything else is decided.
Court fee is calculated under the court-fees legislation as it applies in Uttar Pradesh and normally depends on the value of the claim, so it varies from matter to matter.
